Terms of Service

Welcome to MyGameGrid ("Company", "we", "us", or "our"). These Terms of Service ("Terms") dictate your access to and use of the MyGameGrid website, mobile applications, and any associated services (collectively, the "Platform").

By accessing, browsing, registering for, or using the Platform, you acknowledge that you have read, understood, and accept these Terms in their entirety. If you do not agree with these Terms, you must not access or use the Platform.

IMPORTANT: THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION, A CLASS ACTION WAIVER, AND A COMPREHENSIVE WAIVER OF LIABILITY AND ASSUMPTION OF RISK REGARDING PHYSICAL INJURIES THAT MAY OCCUR DURING EVENTS ORGANIZED OR BOOKED THROUGH OUR PLATFORM.

MyGameGrid acts exclusively as a technology platform that connects individual players, teams, event organizers, and sports venues. We facilitate the discovery, booking, organizing, and payment for sports matches, tournaments, and related events ("Events").

Independent Contractors: We do not own, operate, or directly manage the physical venues, nor do we employ the organizers, referees, or participants. We are not a party to any agreement entered into between organizers and players or venues and players.

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to create an account and use the Platform. By using the Platform, you represent and warrant that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to safeguard your account.

Payment Processing: We use third-party payment processors (e.g., UPI providers, Stripe, etc.) to bill you for services and Event fees. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor in addition to these Terms. We are not responsible for errors by the payment processor.

Platform Fees: MyGameGrid may charge a service fee or convenience fee for bookings and transactions made through the Platform. All applicable fees will be displayed prior to checkout.

Refunds and Cancellations: Refund policies for specific Events are determined by the individual Event organizer or venue, not by MyGameGrid. MyGameGrid acts merely as a facilitator and is not responsible for initiating refunds unless explicitly provided in a specific Platform-wide policy or mandated by law. In the event of an organizer-cancelled Event, you must seek your refund directly through the organizer or accordance with the specific Event policy.

Taxes: You are responsible for paying any applicable taxes associated with your use of the Platform and any Events you attend or organize.

You agree not to use the Platform to:

• Violate any local, state, national, or international law or regulation.
• Harass, abuse, intimidate, or discriminate against other users, organizers, or venue staff.
• Post false, misleading, defamatory, or obscene content.
• Interfere with or disrupt the integrity or performance of the Platform.
• Organize fraudulent Events or collect payments under false pretenses.

User Content: By submitting photos, reviews, team names, or other materials ("User Content") to the Platform, you grant MyGameGrid a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your User Content in connection with operating and promoting the Platform.

You agree to defend, indemnify, and hold harmless MyGameGrid, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms or any applicable law.
• Your use of the Platform, including but not limited to your User Content.
• Your interaction with any other user, organizer, or venue.
• Your participation in any Event booked or organized through the Platform.

THE PLATFORM AND ALL CONTENT, SERVICES, AND EVENTS PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MYGAMEGRID, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE PLATFORM, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF FORESEEABLE.

IN NO EVENT SHALL MYGAMEGRID\'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100 USD) OR THE AMOUNT YOU PAID TO MYGAMEGRID IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in the jurisdiction where MyGameGrid is headquartered, before one arbitrator. Judgment on the Award may be entered in any court having jurisdiction.

Class Action Waiver: YOU AND MYGAMEGRID AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.
